GAME – Terms of Service

By accessing this website, booking any service, or using any media created by GAME, you (“Client”) acknowledge and agree to be legally bound by these Terms without exception. If you do not agree, you are strictly prohibited from using the Services.

1. Scope of Services

GAME provides real estate photography, videography, drone operations, and digital media production at our sole discretion.
All creative decisions—including, but not limited to, angles, lighting, composition, editing style, color grading, pacing, and final output—are made exclusively by GAME and are not subject to client approval or revision unless purchased separately.

2. Payment Requirements

2.1 Payment Is Mandatory

Payment is due at the time of service unless another arrangement is explicitly documented by GAME.
No images, no videos, no previews, no raw files, and no unfinished media of any kind will be released until payment is received in full.

2.2 Chargebacks Strictly Prohibited

Chargebacks, payment disputes, or unauthorized reversals are considered intentional fraud.
In the event of a chargeback, GAME reserves the right to:

  • Revoke all licensing rights

  • Issue DMCA takedowns on all platforms

  • Pursue civil action for damages, attorney fees, and unpaid licensing

  • Report the incident to payment processors and collection agencies

3. No-Refund Policy (Non-Negotiable)

All payments are 100% non-refundable, with no exceptions.
Refunds will NOT be issued for dissatisfaction with:

  • Artistic style

  • Editing choices

  • Weather conditions

  • Property condition

  • Access limitations

  • Listing changes

  • Client expectations

  • Third-party complaints (sellers, buyers, family, agents, etc.)

By booking GAME, you acknowledge that you have reviewed our portfolio and fully accept our artistic and technical approach.

4. Cancellations & Rescheduling

  • Canceling within 24 hours of your appointment may result in a fee up to 50% of the service price.

  • No-shows are automatically billed at the full price.

  • Weather delays do NOT qualify for refunds. GAME will reschedule at our discretion.

GAME is not required to accommodate last-minute changes, delays, staging issues, property access issues, or seller-related delays.

5. Client Responsibilities

The client is solely responsible for ensuring the property is in photo/video-ready condition. GAME will not clean, declutter, stage, or move items.

If the shoot is delayed due to property condition or lack of access, GAME may:

  • Charge a reshoot fee

  • Shorten the session

  • Cancel the session without refund

6. Ownership of Media

GAME retains full and exclusive ownership of all media created—including raw files, edited files, drone footage, photos, videos, and any derivative works.

You are purchasing a license, NOT ownership.

Under no circumstances does the client obtain copyright ownership.

7. Licensing (Strict Usage Limits)

Upon full payment, the client receives a limited, non-transferable license for single-listing real estate marketing only, including:

  • MLS

  • Zillow, Realtor.com

  • Property flyers, brochures

  • Social media posts for that specific listing only

Unauthorized Uses (Strictly Prohibited):

Clients may NOT:

  • Share media with builders, contractors, stagers, designers, or third parties

  • Use media for long-term branding or business promotion

  • Sell, license, or sublicense media

  • Remove GAME branding or metadata

  • Use media after the listing expires

  • Use media before paying for it

Each unauthorized use constitutes copyright infringement subject to legal action, statutory damages, and licensing penalties.

GAME actively monitors unauthorized use and enforces copyright through DMCA filings, legal notices, and civil damages claims.

8. No RAW Files & No Unedited Footage

GAME does not release RAW images, unedited video, unused drone footage, or proprietary files.
Requests for raw footage will be denied without explanation.

9. Delivery & Withholding Rights

GAME reserves the right to withhold delivery of all files if:

  • Payment has not been made

  • The client violates these Terms

  • The client files or threatens a chargeback

  • The client uses media without authorization

GAME may permanently withhold or revoke access in the event of misuse.

10. Drone Operations (Legal Compliance Required)

Drone flights are controlled entirely by the FAA-certified pilot in command (PIC).
The PIC may cancel or modify the flight at any time for safety or legal reasons. This does not qualify for a refund.

Restricted airspace limitations are final and non-negotiable.

11. Website & Content Ownership

All website content—including images, videos, logos, text, graphics, pricing, and layouts—are owned by GAME.
Unauthorized copying or reuse is strictly prohibited and will result in legal action.

12. Prohibited Conduct

Clients are strictly prohibited from:

  • Attempting to negotiate refunds outside policy

  • Posting slanderous, defamatory, or misleading statements about GAME

  • Altering or editing GAME’s media

  • Sharing files with unauthorized parties

  • Using media before paying for it

  • Interfering with website security or operations

GAME reserves the right to refuse service, terminate access, or pursue legal remedies if violations occur.

13. Limitation of Liability (Maximum Protection for GAME)

GAME’s total liability for any claim is limited to the amount paid for the service.
GAME is not liable for:

  • Lost sales or listing opportunities

  • Delays beyond our control

  • Weather impacts

  • Property or staging quality

  • MLS formatting issues

  • Indirect, incidental, consequential, punitive, or special damages

No exceptions.

14. Indemnification

Client agrees to indemnify, defend, and hold harmless GAME from all claims, damages, legal fees, or disputes arising from:

  • Misuse of media

  • Violations of these Terms

  • Unauthorized sharing or publication

  • False statements or defamatory behavior

  • Third-party claims related to your listing or use of media

This includes paying GAME’s legal fees in full.

15. Governing Law

These Terms are governed exclusively by the laws of the state where GAME is headquartered.
Any disputes shall be resolved in that jurisdiction, and the client waives any objection to venue.

16. Changes to Terms

GAME may modify these Terms at any time without notice. Continued use of the website or services constitutes acceptance of all updates.
